1. About this service

These Terms apply to the Seedream 5.0 Pro website at seedream-5pro.com, an independent AI image-generation and image-editing application. This website is not ByteDance's official website and is not affiliated with, endorsed by, or operated by ByteDance. Model and product names belong to their respective owners; mentioning a model does not imply a partnership.

The service lets you submit text prompts and, where supported, reference images to request digitally delivered AI-generated images. It uses third-party model, hosting, and payment services. We do not sell physical goods or guarantee a particular creative result.

By creating an account or using the generation service, you agree to these Terms and the Acceptable Use Policy. The Refund and Cancellation Policy explains payment remedies. The Privacy Policy and Cookie Policy explain data handling and optional analytics choices; using the website does not by itself consent to optional tracking.

2. Eligibility and account security

You must be at least 18 years old, have reached the age of majority where you live, and be legally able to enter this agreement to create an account, purchase, or use the generation service. If you act for an organization, you must have authority to bind it.

Provide accurate account and billing information, protect your sign-in credentials, and do not share or sell your account or use someone else's account without authorization. Tell us promptly if you suspect unauthorized access. You are responsible for your own activity and activity you authorize, but these Terms do not make you automatically liable for every unauthorized action.

3. Your uploads, prompts, and permissions

You retain any rights you already hold in your prompts, reference images, and other submitted content. You must own that content or have the permissions needed to upload it, have it processed by our service providers, and use the resulting images. This includes copyright, trademark, privacy, publicity, and likeness rights, and any necessary permission from depicted people. Do not submit another person's confidential or sensitive information without authority.

You grant us a non-exclusive, worldwide, royalty-free license only to host, copy, transmit, technically adapt, and process your submissions and results as needed to provide the requested service, deliver and store results, enforce our safety rules, resolve support requests, and meet legal obligations. Relevant service providers may perform these tasks on our behalf. This is not a general license to sell your content, publicly redistribute it, use your likeness in advertising, or claim ownership of it. Retention and deletion are addressed in the Privacy Policy.

Consent from a depicted person does not override prohibited-content rules. In particular, consensual, artistic, or fictional framing does not permit sexual, nude, or undressing content under our Acceptable Use Policy.

4. AI outputs and commercial use

Subject to these Terms and rights that others may hold, you may download and use your generated images for personal or commercial projects. We do not claim ownership of your outputs merely because you generated them here. This permission does not transfer someone else's intellectual property or grant rights to a real person's identity, a trademark, a copyrighted character, or protected source material.

AI outputs may be inaccurate, distorted, biased, unexpected, or similar to outputs generated for other users. We do not promise exclusivity, copyright eligibility, ownership of legally unprotectable material, or freedom from infringement. You must review outputs and obtain any additional permissions needed before publishing, selling, advertising with, or otherwise relying on them. Do not misrepresent AI-generated media as an authentic photograph, genuine endorsement, or evidence of a real event in a way that deceives or harms others. Provide AI disclosures where required by law or the platform on which you publish.

5. Credits, payments, and digital delivery

Prices, currency, billing intervals, and included credits are displayed in the purchase flow. Generation uses site credits at the rate shown for the selected options. Credits are units for using this service, not money, a deposit, or a transferable financial asset.

Subscriptions renew on the billing interval you select unless canceled. Paid subscription credits expire at the end of the billing period for which they were granted and do not roll over; annual-plan credits are granted for the annual billing period. Canceling renewal does not extend credit expiry or automatically refund a payment. Manage renewal through Settings → Billing → Manage subscription and confirm the effective cancellation date in the billing portal.

Payment confirmation and generation run asynchronously, so credits and results may not appear immediately. Images are delivered through the website rather than physical shipping. Download results you want to keep: the service is not an indefinite archive, and provider-hosted links can become unavailable. If a payment, credit balance, or result is missing, contact support with the relevant receipt or task ID.

A failed charged generation is handled by returning site credits, not by automatically refunding money to your card. Cash-refund eligibility, the seven-day request window, usage deductions, and cancellation details are set out in the Refund and Cancellation Policy. Free, gift, or promotional credits have no cash redemption value. Nothing here removes mandatory consumer remedies.

6. Safety rules and enforcement

You must follow the Acceptable Use Policy, including its restrictions on sexual content, child exploitation, impersonation, fraud, abusive conduct, infringement, and safeguards bypass. Automated checks and, where necessary, human review may result in a refused request, blocked output, cooldown, or account restriction. Checks can make mistakes and do not guarantee every output is safe, lawful, or suitable.

We may restrict or suspend access when reasonably necessary to address a policy violation, security risk, fraud, legal obligation, or harm to others. We may act without advance notice where notice would undermine safety or an investigation. Where appropriate, we will explain the restriction and provide an opportunity to appeal through support. Restrictions do not cancel refund rights or other remedies required by law.

7. Availability and responsibility

Model availability, processing time, and image quality can vary. Maintenance, network problems, provider failures, and safety restrictions may interrupt service. To the extent permitted by law, the service is provided as available without a promise of uninterrupted access, a specific artistic result, or suitability for a particular purpose.

To the extent permitted by law, we are not responsible for indirect or consequential losses arising from use of the service. This limitation does not exclude liability that cannot lawfully be excluded, including applicable liability for fraud, deliberate misconduct, or mandatory consumer protections. It does not replace our delivery and refund commitments in the Refund and Cancellation Policy.

8. Changes and contact

We may update these Terms as the service or legal requirements change. We will publish the revised date on this page and provide an appropriate notice of material changes. Updates do not retroactively remove rights attached to an earlier purchase. If you do not accept a material change, stop using the service and cancel any future renewal; existing statutory and refund rights remain available.
